1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SUS Labs Inc., a Delaware corporation ("SUS", "we", "us", or "our"), governing your access to and use of the SUS mobile application and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

2. Description of Service

SUS is an interactive computer service and anonymous social platform that allows users to:

  • Create and join anonymous groups via shareable links
  • Create subjects (topics, people, or questions) within groups for discussion
  • Post anonymous messages and comments
  • Create and participate in anonymous polls
  • Send anonymous voice notes (Pro feature)

Platform Status: SUS is an interactive computer service provider under 47 U.S.C. § 230. We are not the publisher or speaker of user-generated content. Users are solely responsible for content they post.

2.1 No Verification of Claims

SUS does not verify the accuracy of user-submitted content. All statements, opinions, and allegations are solely those of the user who submitted them. SUS does not endorse, confirm, or adopt any user-generated content.

2.2 Opinion and Discussion Platform

SUS is a discussion platform designed for anonymous user opinions and commentary. Content may contain subjective views, satire, or unverified personal experiences. Users are responsible for evaluating the credibility of information posted on the platform.

2.3 No Duty to Monitor

SUS has no obligation to monitor user content but reserves the right to do so at its discretion.

2.4 Assumption of Risk

By using SUS, you acknowledge that you may encounter content that is offensive, inaccurate, or objectionable, and you assume all risks associated with accessing such content.

3. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Services under applicable law
  • You will comply with these Terms and all applicable laws

4. Prohibited Conduct

You agree NOT to use the Services to post, upload, transmit, or otherwise make available any content that:

4.1 Illegal or Harmful Content

  • Is illegal, fraudulent, or violates any law or regulation
  • Promotes or facilitates illegal activity
  • Contains malware, viruses, or harmful code
  • Infringes intellectual property rights of others

4.2 Harassment and Abuse

  • Harasses, bullies, intimidates, or threatens any person
  • Is hateful, discriminatory, or promotes violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Stalks or otherwise harasses others
  • Encourages self-harm or suicide

4.3 Defamation and False Statements

  • Posts false statements presented as fact about any individual that could harm their reputation
  • Makes knowingly false accusations or allegations against others
  • Spreads rumors or misinformation intended to damage someone's reputation

SUS reserves the right to remove content that it determines, in its sole discretion, may expose the company or others to legal liability.

4.4 Privacy Violations and Doxxing

  • Posts private information about others without consent, including but not limited to: addresses, phone numbers, email addresses, social security numbers, financial information, or other personally identifiable information
  • Engages in doxxing (revealing someone's identity or private information)
  • Shares intimate images without consent (revenge porn)
  • Impersonates any person or entity

4.5 Sexual and Exploitative Content

  • Contains sexual content involving minors or appears to sexualize minors
  • Promotes or facilitates human trafficking or exploitation
  • Contains non-consensual sexual content
  • Solicits sexual services

4.6 Platform Abuse

  • Spams, floods, or otherwise disrupts the Services
  • Uses automated systems (bots, scrapers) without authorization
  • Attempts to gain unauthorized access to the Services or other users' accounts
  • Interferes with or disrupts the Services or servers
  • Circumvents security measures or access controls

Violation of these prohibitions may result in immediate termination of your access and reporting to law enforcement.

5. User Content and Responsibility

5.1 Your Responsibility

You are solely responsible for all content you post on SUS. You represent and warrant that:

  • You own or have the necessary rights to post the content
  • Your content does not violate these Terms or applicable law
  • Your content does not infringe third-party rights
  • You accept full liability for your content

5.2 License to SUS

By posting content, you grant SUS a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, publicly display, and publicly perform your content in connection with operating and providing the Services.

You retain ownership of your content. This license terminates when you delete your content, except where content has been shared with others and they have not deleted it.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion, without notice. We are not obligated to monitor content but may do so.

6. Moderation and Reporting

6.1 Content Moderation

We use AI-powered content moderation and human review to detect and prevent harmful content. We reserve the right to:

  • Remove content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Report illegal activity to law enforcement
  • Cooperate with law enforcement investigations

6.2 Reporting Mechanism

Users can report content that violates these Terms by:

  • Using the in-app reporting feature
  • Emailing abuse@trysus.link

We will review reports within 24-48 hours and take appropriate action.

6.3 Blocking

Users can block groups or subjects to prevent seeing content from them.

7. Subscription and Payment

7.1 Free Tier

  • Create 1 group (expires after 7 days)
  • Text posts limited to approximately 50 characters
  • No polls or voice notes
  • Limited message visibility

7.2 Pro Subscription ($5.99/week)

  • Unlimited groups (no expiration)
  • Text posts up to approximately 500 characters
  • Create and participate in unlimited polls
  • Send and receive anonymous voice notes
  • Full admin controls over groups and subjects
  • Enhanced visibility and features

7.3 Billing and Payment

Payment Processor: Subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android).

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You can cancel your subscription anytime through your device's app store settings (App Store for iOS, Google Play for Android).

Price Changes: We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

Refunds: Refunds are handled according to the app store's refund policy (Apple App Store or Google Play Store). Contact the respective app store for refund requests. We do not process refunds directly.

7. Defamation Notice Process

If you believe content on SUS is defamatory, please submit a written notice to legal@trysus.link including:

  • The URL or content identifier of the allegedly defamatory content
  • The specific statement(s) you claim are defamatory
  • A statement explaining why the statement(s) are false
  • Your contact information (name, email, phone)
  • A statement under penalty of perjury that the information provided is accurate
  • Your electronic signature

We will review defamation notices within 24-48 hours and take appropriate action, which may include removal of the content if, in our sole discretion, it may expose SUS or others to legal liability.

8. Intellectual Property

8.1 DMCA Copyright Policy

We respect intellectual property rights. If you believe content on SUS infringes your copyright, submit a DMCA notice to:

Your notice must include:

  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

8.2 Repeat Infringer Policy

We will terminate accounts of repeat copyright infringers.

8.3 SUS Intellectual Property

The Services, including all content, features, and functionality, are owned by SUS and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

  • The Services will be uninterrupted, secure, or error-free
  • The Services will meet your requirements
  • Any content is accurate, reliable, or complete
  • Defects will be corrected

We are not responsible for user-generated content. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any user content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • BUSINESS INTERRUPTION
  • DAMAGES ARISING FROM USER CONTENT OR CONDUCT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless SUS, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your content
  • Your violation of these Terms
  • Your violation of any law or third-party rights

12. Dispute Resolution and Arbitration

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and SUS agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, rather than in court, except that:

  • You may assert claims in small claims court if they qualify
  • Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights

Arbitration Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision will be final and binding.

Location: Arbitration will take place in San Francisco, California, or another mutually agreed location.

Costs: Each party will bear its own costs, except SUS will pay arbitration fees for claims under $10,000.

12.3 Class Action Waiver

YOU AND SUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and SUS agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

12.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@trysus.link within 30 days of first using the Services.

13. Termination

We may terminate or suspend your access to the Services at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Illegal activity
  • Harmful conduct
  • At our sole discretion

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and dispute resolution.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SUS regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14.6 No Injunctive Relief

In no event shall you seek or be entitled to rescission, injunctive, or other equitable relief, or to enjoin or restrain the operation of the Services or any content.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Posting a notice in the app
  • Sending an in-app notification for significant changes

Continued use of the Services after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
